ROLDO RIGHTS ON JUSTICE MANGLED, DENIED…

As a follow-up to the last posting on the historic battle between the City of Cleveland and the Cleveland Electric Illuminating Company, I am presenting a piece written in 1980 about the first anti-trust trial by the city against the private utility company. It reveals how power works its destruction.

A good deal of it consists of stipulations—agreement as to facts that both side agree—that at the point of that writing—were denied the jury in the trial by Judge Robert Krupansky. In the end, Krupansky allowed the stipulations to be read.

The jury, however, in the first trial voted 6-0 for the city until the third question of five to be answered. One holdout could not be brought along on the third item. Krupansky then ruled a mistrial.

In the second trial, Krupansky, who had relented on the stipulation material, deemed the smoking gun against CEI – would not allow the material to be revealed to the jury.

The stipulations show to any reasonable person that a major Cleveland law firm and the private utility company engaged in an effort to sabotage the city’s electric system, then known as Muny Light, changed to Cleveland Public Power by Mayor George Voinovich. The name and symbol change by Voinovich, I always believed, was his successful effort to alter the name too closely associated with Dennis Kucinich, the man he defeated for mayor.

The stipulations show that CEI, through Squire, Sanders & Dempsey (now Squire Patton Boggs), hired another Cleveland lawyer to pursue a phony suit against the city. The purpose: to delay and deter the city’s attempt to improve its electric system. WHY I BECAME A MAN IN BLACK…

When I had to start making fashion decision for work, I simply put all my suits, shirts and ties in a steady rotation. In the morning I just grabbed the next item in the closet. In the ’90s, when I left the corporate world, I simplified even further and switched to a black jeans and black shirt uniform. I’ve pretty much stuck with that since.

Years later, while reading Willpower: Rediscovering the Greatest Human Strength by Roy Baumeister and John Tierney, I discovered that my strategy actually backing from empirical research. We each have a finite amount of will power each day that once used up, is not easily replenished. Wasting that resource on what trivial decision such as daily fashion decisions is professionally suicidal.

I’d love to hear from women on this strip.
